The principal objective of the thesis thesis was to determine how the judicial control of the presidential pardon for humanitarian reasons undermines the guarantee of the principle of res judicata. In the information gathering stage for the elaboration of the thematic dispersion of the chapters of the theoretical framework, reference sources were used such as books, legal journals, legislation, national and international jurisprudence, using textual records as an information gathering instrument. and comment, as well as the expert questionnaire. Regarding the results of the research developed, 80% of the interviewees are of the opinion that the regulation of pardons for humanitarian reasons is related to the perspective of national and international law, 80% of the interviewees consider that The regulation of pardons for humanitarian reasons from the constitutional point of view is identified with the management and concession phases, and 70% believe that the broad jurisdictional control over pardons for humanitarian reasons granted if undermines the principle of res judicata. The main conclusion is that the jurisdictional control of the presidential pardon for humanitarian reasons is expressed in a negative way by causing an impairment in the guarantee of the principle of res judicata, because it allows its wide control (act of concession) established by the Court Constitutional, Exp. N ° 03660-2010-PHC / TC, so it is necessary to reaffirm its partial control in its management phase or process.
