This investigation seeks to determine a potential legal conflict between article 27 of the Rome Statute, which regulates the inadmissibility of the official position and the immunities of state officials involved in the commission of international crimes, and the constitutional provisions on immunities of senior citizens. Peruvian officials (presidential immunity and parliamentary immunity), which would be given in the area of cooperation between the International Criminal Court and the Peruvian State, in accordance with the obligation of article 86 of the Statute in question. For this purpose, the legal heritage of the ICC is analyzed, as well as the practice of said institution in the prosecution of senior officials who enjoyed immunities at the time the Court requested the cooperation of the State. In addition, the scope of the obligation to cooperate and the need to implement the Statute in internal legal systems are examined, in order to guarantee compliance with that obligation. To this end, the practice of various States Parties regarding implementation, which involved carrying out constitutional compatibility judgments, is comparatively reviewed. In addition, the Peruvian case will be analyzed, which, to date, has not outlined, in our opinion, a correct judgment of constitutional compatibility of the Statute, which would imply that, when the Court requires the cooperation of Peru in an act to deal with any Peruvian senior official with immunity, our authorities are preferably governed by the provisions of the Constitution, generating a violation of our obligation to cooperate with the Court, by not delivering, detaining or extraditing the required official. Finally, an efficient mechanism will be proposed that could resolve this potential legal conflict, and that will involve a ruling by the Constitutional Court and / or a constitutional reform
