In the present investigation, a subject that is highly attended by the doctrine and that has recently been the subject of a jurisprudential pronouncement by the Constitutional Court was addressed: ““REGULATION OF THE PERIODIC REVIEW OF OFFICE OF PREVENTIVE DETAINMENT IN THE PERUVIAN CRIMINAL PROCESS““. The investigation addressed the need for express regulation in the Code of Criminal Procedure of this figure that has already been the object of treatment in the purchased law, where almost all the countries of South America and Central America contain an express legal formula that obliges the judge of guarantees to review preventive detention every certain period of time. An analysis of the legislation has been made specifically of two provisions: article 255 paragraph 2 and article 283, in order to establish, unlike what the Constitutional Court has indicated, that the incorporation of the periodic judicial review of the prison prevention in Peru, since as has been said at the jurisprudential level, variability is one of the most important characteristics that govern the regulation of preventive detention and all measures of coercion in general. The pronouncements at the level of the Inter-American Court of Human Rights were also analyzed, so that the position of the Judiciary on the non-possibility of periodic judicial review of preventive detention can be rejected, taking into account the judicial duty to use conventional control, as allows our Fundamental Charte
