Resumen: La finalidad de esta investigación está enfocada en Describir cómo se
reguló la libertad de comercio, en el ámbito de las constituciones del Siglo XIX en
el Perú, además de analizar la libertad de comercio en el ámbito de las
constituciones del Siglo XIX en el Perú, y finalmente en enfatizar la importancia
del estudio de la libertad de comercio para comprender el desarrollo de la
economía peruana en el siglo XIX. La investigación es de tipo descriptivo, donde
se procederá a un análisis documental exhaustivo, con técnica del fichaje para
comprobar nuestra hipótesis de investigación la cual es que la Libertad de
Comercio en el ámbito de las constituciones del siglo XIX en el Perú no reguló la
libertad de comercio.
A lo largo del siglo XIX, el naciente Perú republicano tuvo ocho
constituciones (1823, 1826, 1828, 1834, 1939, 1856, 1860 y 1867), ninguna de las
cuales fijó instrumentos precisos para el desarrollo comercial y manufacturero.
Esta omisión fue aprovechada por dictadores militares para justificar la restricción
autoritaria de las libertades económicas; trabar el desarrollo de una clase media
tanto productora como compradora; mantener la esclavitud (hasta 1854) y reforzar
la discriminación de las comunidades campesinas indígenas.
A esto se sumó la incapacidad del Estado peruano para aprovechar las
grandes oportunidades de exportación que ofreció el guano de las islas, el salitre
y la fiebre del caucho. Como consecuencia, el Perú quedó estructuralmente débil
y escasamente integrado al ocurrir la Guerra del Pacífico; y, después de dicha
guerra, recién hacia el final del siglo fue posible una real recuperación, sobre todo
por la puesta en vigencia de garantías de Derecho Comercial que habían sido
postergadas.
Finalmente explicaremos que es indispensable una coherencia primordial
entre la Constitución, los Códigos y la legislación ordinaria, para dar a nuestra
sociedad parámetros jurídicos claros que aseguren sus instituciones
democráticas.
The purpose of this research is focused on Describing how the freedom of trade was regulated, in the scope of the constitutions of the XIX Century in Peru, in addition to analyzing the freedom of commerce in the scope of the constitutions of the XIX Century in Peru, and finally in emphasizing the importance of the study of trade freedom to understand the development of the Peruvian economy in the 19th century. The research is of a descriptive type, where an exhaustive documentary analysis will be carried out, with the signing technique to verify our research hypothesis which is that Freedom of Commerce in the field of the 19th century constitutions in Peru was regulated by recognizing the property rights of nationals and the consequent recognition of those rights to foreigners. Throughout the nineteenth century, nascent republican Peru had eight constitutions (1823, 1826, 1828, 1834, 1939, 1856, 1860, and 1867), none of which set precise instruments for commercial and manufacturing development. This omission was exploited by military dictators to justify the authoritarian restriction of economic freedoms; hinder the development of a middle class both producer and buyer; maintain slavery (until 1854) and reinforce discrimination against indigenous peasant communities. Added to this was the inability of the Peruvian State to take advantage of the great export opportunities offered by guano from the islands, saltpeter and rubber fever. As a consequence, Peru was structurally weak and poorly integrated when the War of the Pacific occurred; and, after said war, it was not until the end of the century that a real recovery was possible, especially due to the implementation of commercial law guarantees that had been postponed. Finally, we will explain that a fundamental coherence between the Constitution, the Codes and ordinary legislation is essential, to give our society clear legal parameters that ensure its democratic institutions
