This research work refers to an arduously discussed problem, it has been determined through Plenary Agreement No. 7-2019/CIJ-116 that the misuse and abuse of travel expenses corresponds to an administrative infraction; however, realizing that they are withdrawn from a State budget item and are intended to be used for a public activity, we will proceed to analyze the typical elements of the crime of embezzlement, in order to justify criminal liability. In addition, the different assumptions that originate with the delivery of travel allowances to the official or public servant will be exposed, in order to determine if they should be channeled in the administrative or criminal sphere, highlighting that said assumptions are part of the factual foundations of the case in question. concrete, but not as part of the typicity of the unjust criminal matter of study. It should be noted that, when we find this practice (give travel expenses) quite frequent in public institutions, it is necessary to evaluate the behavior of public agents, and justify the criminal relevance of said acts, well, the state assets and the duties of loyalty and probity are those that are being violated.
