To determine the relationship between compliance with legal requirements of the occupational health and safety policy and the behavior of accident rates in the large-scale mining sector in Peru in the period between 2017 and 2019. Methods: It was an observational - analytical - correlational study. The population was general regime large mining companies registered in the Ministry of Energy and Mines, actives between 2017 and 2019 that met the selection criterial (n = 60). The necessary information was collected through a data collection sheet developed specifically to measure the variables proposed in this research (Annex 01 and Annex 02). In order to obtain the occupational health and safety policies, the web pages were reviewed and for the accident rate, the reports published on the official web page of the Ministry of Energy and Mines were collected. To assess regulatory compliance, a review was requested by 03 certified auditors as leaders of the OSH management system. Subsequently, Spearman's correlation coefficient was applied. Results: The total population was made up of 60 mining companies, of which the inclusion and exclusion criteria were applied, finally leaving 20 mining companies. Spearman's correlation coefficient was applied, obtaining an R of 0.318 with p=0.172. According to what was analyzed, the distribution of the occupational health and safety policy according to its regulatory compliance, where it is shown that 85% (n=17) have regular compliance. The accident rates in the period 2017 to 2019 in general, observing a decrease for 2018 but increasing again in 2019 with an exponential increase trend. Conclusions: The policies are not having an impact on the behavior of the accident rate. More than three quarters of the companies in the mining sector in Peru present a safety and health policy at work that presents regulatory non-compliance with it.
