Abstract: El presente trabajo de investigación tiene como objetivo evaluar si es necesario
complementar las directrices dictadas por la Contraloría de la República en el caso de
la verificación de documentación e información presentada por el postor ganador
establecido en la Ley y Reglamento de Contrataciones con el Estado.
En la actualidad la mayoría de entidades públicas, no cumplen con realizar el Control
Posterior en los otorgamientos de la Buena Pro en las Contrataciones del Estado,
estos hechos se dan por no existir un procedimiento definido en las entidades de dicha
función, por lo que en muchos casos es la Contraloría quien lo realiza de oficio.
Es así, que si bien existen directrices en la Contraloría General de la República y
normativa respecto a Control Posterior y Buena Pro en la Ley de Contrataciones del
Estado, no podemos verificar el nivel de cumplimento de sus funciones, resultando en
un servicio carente de eficiencia y eficacia.
Por ello, el objeto del presente trabajo, es determinar si la normativa y reglamentos,
tanto de la Contraloría General de la República como de la Ley de Contrataciones con
el Estado, son suficientes para realizar una verificación correcta del Control Posterior,
y así validar el proceso de Buena Pro, de tal forma que colabore con la Gestión Pública
en el país.
