Resumen: La presente investigación tuvo como objetivo desarrollar los fundamentos jurídicos
sobre la necesidad de tipificar la violencia obstétrica como un delito dentro del sistema
jurídico peruano. La investigación se desarrolló con un enfoque cualitativo, de tipo básica,
con un nivel descriptivo. Para la recolección de datos se aplicó el método inductivo,
analítico, para lo cual se ha tomado en cuenta la dogmática jurídica.
En ese orden, a través del análisis de la doctrina nacional y extranjera, así como
de la jurisprudencia y de la legislación que existe sobre la violencia obstétrica se ha
concluir que la violencia obstétrica es aquella ejercida contra la mujer, por parte de los
profesionales de la salud, en el marco de una atención de gestación, parto o post parto,
que puede ser de índole física o psicológica con tratos denigrantes y despectivos; y, que
en el Perú, pese haber suscrito varios tratados y convenios internacionales para la
protección de los derechos humanos, no se ha regulado jurídicamente la violencia
obstétrica estableciendo una sanción administrativa o penal para sus perpetradores
The objective of this research was to develop the legal basis for the need to classify obstetric violence as a crime within the Peruvian legal system. The research was developed with a qualitative approach, of a basic type, with a descriptive level. For data collection, the inductive, analytical method was applied, for which legal dogmatics was taken into account. In this order, through the analysis of national and foreign doctrine, as well as jurisprudence and existing legislation on obstetric violence, it was concluded that obstetric violence is that exercised against women by health professionals in the context of pregnancy, childbirth or postpartum care, which can be of a physical or psychological nature with demeaning and derogatory treatment; and that in Peru, despite having signed several international treaties and conventions for the protection of human rights, obstetric violence has not been legally regulated by establishing an administrative or criminal sanction for its perpetrators
