The present investigation analyzes, from a theoretical, jurisprudential and legal perspective, the problematic around the civil liability in regard of the interposition of unnecessary or malicious injunctions, starting from the foreseen in the article 621 of the Civil Procedure Code. The author begins his study by developing the purpose of the precautionary protection, its budgets and characteristics. Based on this, it studies the civil liability derived from the precautionary measures, starting with the unlawful conduct (abuse of right), the moral and material damage, the causal link and the controversy surrounding the applicable imputation criterion; that is, if it is an objective or subjective. After that, it emphasizes the legislative deficiency contained in article 621 of the Procedural Code, as it omits referring to other hypotheses -which, without necessarily ending with an unfounded demand-, could also generate damages. Finally, it addresses the scenario that arises in the face of the insufficiency of the guarantee compensation for damages, and various procedural issues that stem from the problem proposed.
