Gender stereotypes present within the legal system have gained notoriety as a result of controversial judges' rulings, which have been camouflaged through the application of the maxims of experience and when dealing with crimes as delicate as rape of sexual freedom. Victims are often women whose gender roles are so ingrained and still predominate the machoism & misogyny that persists in society. It is aberrant to find barriers that question the actions and the way the victim is dressed, and far from finding the long-awaited justice, by violating due process and judicial protection it only manages to further victimize the victim. Present research addresses this problem; taking as a sample the judicial rulings regarding a crime of this nature; that correspond to the years 2017-2020 of the Court Superior of Justice of Cusco, through five chapters which have been developed under the following structure. The First chapter contemplates the Introduction, and unfolds the problem and the objectives of investigation; this underlines the reasons in which our investigation is justified and delimited. The Second chapter develops the theoretical framework, the background of the research, the theoretical basis and working hypotheses, as well as the study categories. The Third chapter establishes the method on which the present research work was developed. The Fourth chapter, called Thematic Development, includes subchapters based on the categories of Study. Within this research work there are two subchapters: the first called Maxims of Experience and the second Gender Stereotypes. Both of these subchapters contain further subchapters covering definitions of Origin, Typology, Functions, Theories, Systems, Sources, the Role of the state in the face of gender stereotypes within the legal system, the problem as addressed by the Judiciary through international legislation, and the legal consequences that are triggered by the addressed problem. And finally the Fifth chapter, called Results.
