Factores que inciden en el incumplimiento de las medidas de protección por el delito de agresiones contra la mujer en la fiscalia de violencia del Cusco, año 2022

Abstract

El trabajo de tesis tuvo como objetivo identificar y analizar los factores que inciden en el incumplimiento de las medidas de protección establecidas en las investigaciones analizadas por el Tercer Despacho de Investigación de la Fiscalía de Violencia Contra la Mujer y los Integrantes del Grupo Familiar del Cusco por el delito de agresiones en el periodo 2022. Se utilizó un enfoque cualitativo de tipo sociojurídico, para analizar adecuadamente las causas que contravienen las medidas de protección. Con ese fin, se realizaron diálogos presenciales a expertos en la materia, al igual que un análisis documental de carpetas fiscales que permitieron conocer de cerca la realidad de los casos en los cuales se dictaron medidas de protección. Los resultados mostraron que existen factores de tipo interpretativo (asociados al dictado de medidas), administrativos (asociados a la labor de las instituciones) y sociales (asociados a los estereotipos y conductas socialmente aceptables). Ante ello, se recomienda adoptar un enfoque pluridimensional para atender el fenómeno del incumplimiento, el cual se produce por un conjunto de factores que no actúan de manera aislada y por ende, requieren de soluciones desde la educación y la capacitación constantes.

The objective of this thesis was to examine and elucidate the factors contributing to the non-compliance with protective measures in investigations undertaken by the Third Research Unit of the Prosecutor's Office for Violence Against Women and Family Members in Cusco, focusing on assault cases in 2022. Employing a qualitative socio- legal methodology, this study thoroughly explores the underlying reasons for the non- adherence to protective measures. This exploration involved conducting in-depth interviews with subject matter experts and a comprehensive documentary analysis of case files, facilitating a nuanced understanding of cases wherein protective measures were mandated. The findings highlight the presence of interpretative factors (linked to the stipulation of measures), administrative factors (associated with institutional operations), and social factors (related to prevailing societal stereotypes and acceptable behaviors). In response to these insights, the thesis advocates for the adoption of a multidimensional strategy to effectively address the phenomenon of non-compliance, recognizing that it results from an interplay of factors that do not function in isolation. Therefore, addressing this issue necessitates multifaceted solutions that emphasize sustained education and training.
