The conceived, due to his situation of vulnerability, requires the special protection of the State to protect his human life and, in addition, prevent the ties between parents and children from becoming extinct. However, such protection only sometimes materializes in the case of their parents´ separation. That is why this research aims to establish the need for regulating the visitation regime to safeguard the well-being of the conceived in Peru during 2022. For this, a qualitative socio-legal approach was applied, in which interviews were conducted with expert professionals in the subject investigated. Additionally, the researcher conducted a review of specialized bibliography on visitation and the well-being of the conceived. The main conclusion reached was that there is a partial need to regulate the regime of visits to the conceived child since there are equally effective alternatives to guarantee the latter´s well- being. Likewise, situations that put the wellbeing of the conceived child at risk during the gestation stage are indicated such as the lack of medical attention and economic resources. The legal, social, and psychological reasons that justify the regulation of the visiting regime for the benefit of the conceived child are also described in the research. Next, the study develops ways to protect the interests of the conceived children to ensure their proper development in cases of their parents´ separation. Regarding the recommendation, we suggest to researchers the path they should take when investigating this topic and the State entities related to or mentioned in this thesis to be more careful when paying attention to pregnant mothers.
