Las sanciones a los generadores gastronómicos de residuos sólidos en la Municipalidad Distrital de San Sebastián en el año 2019

Abstract

La investigación se basa en las sanciones a los generadores gastronómicos impuestas dentro de la jurisdicción de la Municipalidad de San Sebastian es en el ejercicio de su potestad sancionadora y conjuntamente con las funciones de supervisión y fiscalización de su competencia. La investigación tiene la finalidad de analizar y verificar la eficiencia de las sanciones en aplicación de los instrumentos normativos de gestión los cuales tipifican y describen el procedimiento administrativo sancionador a los generadores gastronómicos y determinar cuál es la causa de la deficiencia en la ejecución de un procedimiento sancionador. Es conforme a la ley Orgánica de Municipalidades 27972 sustancialmente el artículo 80 el cual señala que tienen las municipalidades la potestad de sancionar y legislar en materia de residuos sólidos, así como el de brindar el servicio de limpieza pública, por otro lado, el Decreto Legislativo N ° 1278 el cual aprueba la Ley Gestión Integral de Residuos Sólidos regula la materia los residuos sólidos señala que los gobiernos locales tienen la función supervisora sancionadora, fiscalizadora reafirmando funciones en la municipalidad . Es en ese entender la función sancionadora es otorgada a la municipalidad por ley en el ejercicio de sus facultades debería de ejercer sus funciones de manera eficiente, pues se observa en el territorio municipal abundante cantidad residuos sólidos desechados por parte de generadores de Residuos Gastronómicos en lugares inadecuados en (las calles, esquinas, generando así puntos griticos). La investigación pretende demostrar la ineficiencia en la imposición de las sanciones y cuáles son las infracciones tipificadas a los Generadores Gastronómicos de tal manera que se puedan verificar, posteriormente se implemente medidas para la mejora y que las sanciones en la municipalidad sean eficientes.

The purpose of the investigation is to analyze and verify the efficiency of the sanctions in the application of the regulatory management instruments which typify and describe the sanctioning procedure for gastronomic generators and determine what is the cause of the deficiency in the execution of a procedure sanctioner. Article 80 is substantially in accordance with the Organic Law of Municipalities 27972 which indicates that the municipalities have the power to sanction and legislate on solid waste, as well as to provide the public cleaning service, on the other hand, the Legislative Decree N ° 1278, which approves the Solid Waste Comprehensive Management Law, regulates the matter of solid waste, indicates that local governments have the sanctioning, supervisory, supervisory function, reaffirming functions in the municipality. In this sense, the sanctioning function is granted to the municipality by law, in the exercise of its powers, it should exercise its functions efficiently, since it is observed in the municipal territory an abundant quantity of solid waste discarded by generators of Gastronomic Waste in places inadequate in (the streets, corners, thus generating loud points). The investigation shows to demonstrate the inefficiency in the imposition of the sanctions and the decisions are the offenses typified to the Gastronomic Generators in such a way that they can be verified, later measures are implemented for the improvement and that the sanctions in the municipality are efficient.
