The general objective of the present investigation was to determine whether the non-application of judgment N° 06681-2013-PA/TC (Cruz Llamos) constitutes a factor prejudicial to the principle of the right of equality in the case of special project workers under the COPESCO Plan, Cusco-2022. For this, the literary search of concepts such as the principle of equality and workers' rights in Peru was carried out. Also, the study of the jurisprudence issued by the Supreme Court interpreter of the Constitutional Court of the country. Its realization sought to expand a doctrinal and argumentative research, applying a documentary analysis with a hermeneutic design. Judgment N° 06681-2013-PA/TC (Cruz Llamos) excludes municipal workers from the application of the binding precedent Huatuco Huatuco, and therefore not applicable to COPESCO Special Project workers who are workers belonging to Law 30889 Law which specifies the labor regime of workers of regional and local governments. This discriminatory application of the Huatuco Huatuco precedent to COPESCO Special Projects workers violates the principle of equality, since municipal workers are treated differently from COPESCO Special Projects workers. In addition, COPESCO Special Projects workers do not have the opportunity to take advantage of the benefits granted by the precedent Huatuco Huatuco.
