Resumen: El presente informe versa sobre una demanda de nulidad de acto jurídico a efectos de que se declare nulo un contrato de compraventa por causales de finalidad ilícita, simulación absoluta e infracción a la ley. En virtud de dicho contrato, el demandado pretendió transferir un bien inmueble respecto del cual ostentaba parcialmente la propiedad, siendo que parte de dicho inmueble había sido previamente transferido al demandante. En ese sentido, se analizan los argumentos planteados por el demandante para sustentar su posición y se rebaten los mismos sobre la base de la doctrina, jurisprudencia y normativa civil vigente aplicable al caso. Posteriormente, y de forma alternativa a la calificación que se le otorgó al acto jurídico materia de nulidad, se evalúa el contrato de compraventa de bien ajeno bajo el ordenamiento peruano para determinar que es la figura adecuada para enmarcar la legalidad de los hechos del caso. Habiendo comprobado lo anterior, se analizan y proponen las reglas aplicables para el caso en concreto en sustitución de la demanda de nulidad planteada. Específicamente, se discute la figura de concurrencia de acreedores así como los principios que rigen el derecho registral en materia de buen fe y oponibilidad. Finalmente, se comentan y contradicen las sentencias más importantes del caso y, así, se fija una postura personal sobre el mejor proceder para resolver la demanda planteada.
This report deals with a claim for nullity of a legal act for the purpose of declaring a purchase and sale agreement null and void on the grounds of unlawful purpose, absolute simulation and infringement of the law. By virtue of said contract, the defendant intended to transfer a real estate property in respect of which it held partial ownership, being that part of said property had been previously transferred to the plaintiff. In this regard, the arguments raised by the plaintiff to support its position are analyzed and rebutted on the basis of the doctrine, jurisprudence and civil law applicable to the case. Subsequently, and as an alternative to the qualification given to the legal act subject to nullity, the contract of sale of another's property under Peruvian law is evaluated to determine that it is the appropriate figure to frame the legality of the facts of the case. Having ascertained the above, the applicable rules are analyzed and proposed for the specific case in substitution of the nullity claim raised. Specifically, the figure of concurrence of creditors is discussed, as well as the principles that govern the registry law in matters of good faith and opposability. Finally, the most important rulings of the case are commented and contradicted and, thus, a personal position on the best procedure to resolve the claim is established
