Our thesis, titled: “THE APPLICATION OF THE COMMUNAL STATUTE AND ITS EFFECTS IN THE PEASANT COMMUNITY OF TRAPICHE (SICUANI-CUSCO) 2022”, had as its main objective to determine whether the application of the Communal Statute towards the members of the peasant community of TRAPICHE is effective. Trapiche, since, as is well known, the communal statute applies to those who are an integral part of a certain community, so its creation is based on the community law Law No. 24656, which is considered the mother law of the communities. peasants of the Peruvian territory, it should also be noted that all the communities that have their respective communal statutes must constantly update them according to the current reality, however it has been seen that the peasant communities do not update their communal statutes, which they maintain an outdated statute, nor do they have their respective internal regulations, which is the complement of a communal statute, therefore we have been able to visualize that the peasant community of Trapiche that is located within the district of Sicuani of the province of Canchis of the department of Cusco, it does have a statute, but it is outdated, that is, the update of its communal statute was not carried out and as a result of this, the poor application of the communal statute towards the members of the certain peasant community of Trapiche and It also violates the right to equality enshrined in our Magna Carta in paragraph 2) of article 2, in the law of peasant communities Law No. 24656 and the fundamental principle of the peasant community of Trapiche stipulated in its communal statute as a basic guiding principle In the same way, it was possible to verify that the community does not have an internal regulation which serves as a complement to the communal statute, and in this way allows a better application of its statute towards its members who are members of the peasant community of Trapiche and in that way The right to equality of the community members of the aforementioned community does not continue to be violated, either by applying the broad statute for one and a narrow one for others, this being the case, an application should be carried out in an ideal and equal manner as the situation warrants, which is not evident in the peasant community of trapiche. Therefore, to corroborate that the communal statute of the Trapiche peasant community really becomes ineffective in its application towards its members, various instruments were used, including interviews with the directors and former directors of the Trapiche peasant community, as well as as well as surveys carried out to public and private institutions that know about the reality of the peasant communities and in the documentary analysis part where the analysis sheets were used, such as the magazine prepared by the peasant community of Trapiche and the communal statute of the mentioned, which all of this would corroborate the hypothesis raised in the present project, therefore the implementation of an internal regulation to the communal statute of the Trapiche peasant community would be proposed, as well as the updating of the communal statute according to the current reality and Finally, the promotion of talks by public and private institutions knowledgeable about the interpretation and correct application of the communal statute allowing an improvement in the organization of the community, and that in this way the right to equality or any other another right that every person possesses and based on these proposals they can be applied consistently in all the communities of the Sicuani district for the benefit and improvement of each Peasant community.
