Resumen: En los últimos años transcurridos, la actividad turística se ha incrementado
notablemente a nivel mundial acompañado de diversos cambios en sus
modalidades de comercialización de servicios, siendo así que anteriormente
predomino en muchos sentidos una actividad turística urbana o tradicional, sin
embargo esta actividad fue desarrollándose a través de los años trayendo
consigo otra alternativa turística, llamada activa o de aventura la cual es
practicada en la naturaleza utilizando los recursos que esta brinda siendo por
tierra mar o aire, pero que también implica riesgo para los usuarios de este
servicio.
No siendo ajeno a este nuevo turismo el Perú, el cual capta una gran afluencia
de ciudadanos extranjeros que en gran parte visitan la Ciudad del Cusco, siendo
considerado en la lista de los 12 países con mayor biodiversidad del mundo,
privilegiado con cerca de 158 áreas naturales protegidas.
Sin embargo, este tipo de turismo posee una gran cantidad de informalidad y una
insuficiente regulación, pues al ser realizado al aire libre contienen algunos
elementos de riesgo, peligrosidad o posibilidad cierta de sufrir un daño al ser una
actividad muy accesible en la que muchas veces solo es necesario en uso de
equipamiento básico y una localización especifica, sin considerar o tomar muy
en cuenta las condiciones de salud de los usuarios.
La Ley 29408 LEY GENERAL DE TURISMO y en específico al Turismo de
Aventura con el Reglamento de Seguridad para la Prestación del Servicio
Turístico de Aventura DECRETO SUPREMO Nº 005-2016-MINCETUR este
cuerpo legal resulta insuficiente para tutelar adecuadamente los intereses del
viajero, las leyes nacionales específicas solo establecen ciertos parámetros para
su funcionalidad, implantando asi modalidades de comercialización masiva de
los servicios turísticos mediante contratos de adhesión en los que
frecuentemente la empresa inserta cláusulas abusivas tal como la liberación de
responsabilidad antes de brindar cualquier tipo de servicio en las que el usuario
se ve imposibilitado de cualquier tipo de negociación aceptando completamente,
la norma no posee un claro criterio legal acerca de la responsabilidad civil en caso de algún accidente, sobre todo cuando las empresas se respaldan en la
asunción del riesgo.
In the last few years, tourist activity has increased notably worldwide accompanied by various changes in its service marketing modalities, while previously an urban or traditional tourist activity predominated in many ways, however this activity was developing gradually. Through the years, bringing with it another tourist alternative, called active or adventure, which is practiced in nature using the resources it provides, being by land, sea or air, but which also implies risk for the users of this service. Peru is no stranger to this new tourism, which attracts a large influx of foreign citizens who largely visit the City of Cusco, being considered in the list of the 12 countries with the greatest biodiversity in the world, privileged with about 158 areas protected natural. However, this type of tourism has a large amount of informality and insufficient regulation, since being carried out in the open air contains some elements of risk, danger or the certain possibility of suffering damage as it is a very accessible activity in which many times it is only necessary in the use of basic equipment and a specific location, without considering or taking into account the health conditions of the users.
