The normative evolution generates the need to build and improve the legal bodies. The reason forthis regulatory improvement is based on the need to limit the capacity to oppose, in the cases referred to, the prescription, of an acquisitive nature. That is, that there are explicitly established requirements, to be able to oppose a claim of acquisitive prescription, this taking into account thelegal nature of the usucapión, as well as the scope of the opposability, and at what point both converge in the search for the interest of society, beyond the individuals who seek the recognitionof their right to property. In summary, we consider and demonstrate through this research, the need to include in article 950,requirements that limit of opposability, based on what is indicated by article 2022 of the same normative body, in order to avoid; the excesses in the discretionary criteria of the magistrates, theexcessive procedural times, to which the judicial operators are subjected, as well as litigants, in order to apply the principle of speed, in the recognition and formalization of the right of property. As Huanca (2013) points out, legal situations are regulated according to personal and collective interests, giving priority to the second over the first, in case of discrepancy, emphasizing that, overthe years, greater regulation is required, in search of regulatory effectiveness and therefore of the entire legal system, who has the obligation to grant legal certainty.
