Separación de patrimonios en la unión de hecho Iquitos 2020

Abstract

La presente investigación partió del problema ¿El Código Civil contempla en su normativa legal la separación de patrimonios en la Unión de Hecho? Y el objetivo fue: Identificar si el Código Civil contempla en su normativa legal la separación de patrimonios en la Unión de Hecho. La técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por 70 abogados colegiados del Distrito Judicial de Loreto. El diseño que se empleo fue no experimental de tipo transaccional correlacional. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables en forma independiente y para demostración de las hipótesis se usó la prueba paramétrica hi cuadrado (x2). Los resultados indicaron que: El Código Civil no contempla la separación de patrimonios en la Unión de Hecho, tan solo contempla la que dicha unión origina una sociedad de bienes que se sujeta al régimen de sociedad de gananciales.

The present investigation started from the problem: Does the Civil Code contemplate in its legal regulations the separation of assets in the De facto Union? And the objective was: Identify if the Civil Code contemplates in its legal regulations the separation of assets in the De facto Union. The technique used was the survey and the instrument was the questionnaire. The population was made up of 70 registered lawyers from the Loreto Judicial District. The design that was used was non-experimental of a transactional correlational type. Descriptive statistics were used for the statistical analysis, for the study of the variables independently and for the demonstration of the hypotheses, the parametric chi square test (x2) was used. The results indicated that: The Civil Code does not contemplate the separation of patrimonies in the De facto Union, it only contemplates that said union originates a property company that is subject to the community property regime.
