In the research, the problem is formulated What justifies incorporating factor aggravating coerced to providing personal work without proper labor remuneration teenager in Article 168 of the Penal Code, to ensure the protection of remuneration of teens work in Peru? The issue regulations encompassing today, is the shortage of adolescent workers caution when labor compensation fails, and consequently defines the violation, hurting the weakest in society, "the teen worker" to which the employer has knowledge of inadequate primary criminalization promises, paragraph 2 of Article 168 of the Penal Code, as the offense does not identify the degree of injury legal right of personal retribution, exercised the taxpayer, is "a adult or teen ", in finding the perpetrator applies the same penalty no matter who injured their rights more seriously, and it is right that the adolescent receives greater protection than adults. And to arrive at the solution of writing objective, determining factor justifying the inclusion of aggravating coerced into providing personal work without proper labor remuneration teenager in Article 168 of the Penal Code, to ensure the protection of the right to remuneration of working adolescents in Peru based on information search compared Criminal law: Bolivia, Brazil, Colombia, Ecuador, San Salvador, Spain, Venezuela, and later to develop the technique of comparison, to verify protection in other criminal laws, but also with the conventions of the ILO international organization, which led to the comparison of rights found in Peruvian criminal law; doctrines also examined with reference to the subject which helped to verify the variety of authors, who study the problem under discussion article also found similar thesis to the subject, but with different types of research. Information gathering, why that section has exposed flaws in the taxpayer of the criminal and penal legal consequence, and to get the result we used methods such as deductive, which served to achieve results through broad general observation, to public and private entities that incorporate adolescent workers who are paid, and the dogmatic method was used because of the need to know, as it adversely affects standard taxpayer, but always limited to the standard, and for better solution, a study on comparative law, also used field techniques and documentary, showing the exercise of prejudice, through interviewing Manthoc the Organization, and also the collection of different theories that were necessary to support the hypothesis. Also, thanks to these procedures were obtained effectiveness of the results, as support for the development of the thesis, in which he described the primary criminalization inadequate (incorrect application of the penalty to the perpetrator, whether the taxable person or an adult minor, applies equally to the offending agent imprisonment not exceeding two years), affecting the Constitution of Peru, International Conventions of the ILO, and legally protected personal pay young workers , to fix the problem it was hypothesized: "The factor that justifies the inclusion of aggravating coerced to providing personal work without proper labor remuneration teenager in Article 168 of the Penal Code is considered as taxable teenager in the basic offense, which leads to inadequate criminal protection to freedom of work. " Also, it is considered that the regulation is applied throughout Peru, but has been limited within the city of Cajamarca.
