The objective of this research is to determine whether or not the constitutional right to defense is guaranteed by the designation of the necessary technical defense in pretrial detention hearings in the preparatory investigation courts of Cajamarca during the year 2020, of the Superior Court of Justice of Cajamarca; especially in those cases in which the designation of the necessary technical defense is given in the act of the pretrial detention hearing; as well as if they have reasonable time to prepare the defense strategy of the accused. The study methodology used was basic, with a qualitative approach and non-experimental design, using interviews and documentary analysis. From the analysis of the interviews, it is essentially argued that the designation of the necessary defense attorney at the pretrial detention hearing is not in accordance with constitutional rights, especially because it is an ineffective defense; In this sense, procedural defense should not only be understood as a subjective right, but as a true legal action that contradicts the assumptions of the criminal plaintiff in favor of the person under investigation; and for this to occur, other important axes should also be taken into account, such as the necessary and proportional time that according to each type of process (simple, complex or organized crime) should be provided to the technical defense to carry out an adequate defense. Finally, it is concluded that the constitutional right to defense is not guaranteed with the designation of the necessary technical defense in the pretrial detention hearings in the Preparatory Investigation Courts of the Judicial District of Cajamarca, thus violating the right to equality of arms of the defendants since the defense is not efficient.
