As a society, we are aware that the absence of regulation of surrogacy has not prevented or limited its irregular treatment in Peru. That is why, over time, the existence of the illegal practice of surrogacy has been evidenced, putting at risk mainly the health of the surrogate mothers. The purpose of this research was to identify the main findings on surrogacy, based on the analysis of the right to health of the surrogate mother and its non-regulation in Peru. The research design was non-experimental, with a qualitative approach, sources of information from scientific articles from 2019 to 2023, and the application of interviews to constitutional, civil and family lawyers. In the research carried out, it was obtained that, in Peru, the General Health Law in its article 7°, tacitly prohibited the reproductive technique by conditioning its use only when the genetic mother and the pregnant mother are the same person, being necessary a regulation and control to avoid its clandestine practice and that in this way the health of the pregnant mothers would not be put at risk.
