Resumen: El presente caso es sobre un menor con TDAH al que se le negó la renovación de su
matrícula en su colegio. Por ello, se busca responder en qué medida el Tribunal
Constitucional ha interpretado su derecho a la educación, y responder si su decisión
ha sido correcta o no. Por tal motivo, las herramientas de apoyo en el presente trabajo
son: jurisprudencia, leyes, informes y artículos.
Como principal objetivo se busca determinar qué preguntas le han faltado responder al
Tribunal para lograr obtener una mejor respuesta en el análisis del caso y cómo estas
plantean una mejor perspectiva de solución. Los resultados confirman que sí afectó el
derecho a la educación del menor al no renovarle la matrícula y que la posición del
Tribunal no es la más adecuada porque no hizo énfasis en plantear el concepto de
educación inclusiva para el presente caso. Además, no analizó qué otros derechos
fueron afectados. Por último, como alternativas de solución es importante que como
sociedad busquemos formar parte de la problemática porque si más personas saben
qué hacer cuando conviven con una persona que tiene TDAH se estará ayudando a
generar un mejor ambiente que permita el respeto de sus derechos.
The present case is about a minor with ADHD who was denied the renewal of his registration at his school. Therefore, it seeks to answer in what extent the Constitutional Court has interpreted their right to education, and answer if its decision has been correct or not. For this reason, the supporting resources in this paper are: jurisprudence, laws, reports and articles. The main objective is to determine which questions the Court has failed to answer in order to achieve a better response in the analysis of the case and how these determinates a better solution. The results confirm that the right to education was affected because the school denied the renewal of his registration and that the Court's position is not the most appropriate because it did not emphasize the concept of inclusive education in the present case. In addition, it didn’t analyze what other rights were affected. Finally, as alternative solutions, it is important that society takes part of the problem because if more people know what to do when they live with a person who has ADHD, they will be helping to create a better environment that allows respect for their rights.
