The legal report in which the reader is about to enter seeks to analyze Cassation N˚1583-2018-Cusco, issued by the Permanent Civil Chamber of the Supreme Court. The context of this cassation judgment takes place in the process of nullity of legal act filed by Doris Becerra Lira against Jesús Romero Arias and the spouses Lorenzo Condori Flores and Asencia Chara Hancco, by which it is sought, mainly, the declaration of nullity of the purchase and sale contract entered into between the defendants. In said proceeding it is debated whether the spouses should be considered third parties of good faith in the registry. Having said the above, the main problem proposed is to determine whether the spouses Lorenzo Condori Flores and Asencia Chara Ancco should be protected by the principle of good faith in the registry regulated in article 2014 of the Civil Code, before its amendment. To this end, we will rely on our national doctrine and jurisprudence. In addition, since this work seeks the protagonism of procedural law, we will address the analysis of ex officio evidence, as well as the evidentiary motivation, being pertient articles 194 and 197 of the Civil Procedural Code, and we will include some of the rules of the X Plenary Civil Cassation. Finally, we would like to advance to the reader that the conclusion we reach is that the spouses should have been protected by the principle of good faith in the registry, since the evaluation made of the same included the arbitrary application of certain procedural rules, which contributes to reach an erroneous conclusion.
