The objective of this investigation was to determine if the breach of the visitation regime by the obligated parent constitutes civil liability for damage caused to the child and adolescent in Peru, year 2022. The qualitative approach methodology and a basic research of descriptive research design were used, studying 15 extrajudicial conciliation acts with visitation agreements issued in the “Cultura Pacis“ Conciliation Center. Using the survey and in-depth interview as a data collection technique, applying the survey form and structured interview form as a data collection instrument. As a result, the existence of cases of non-compliance with the visitation regime by the beneficiary parent was obtained, a fact that generates psychological, material, and/or emotional damage to the child and adolescent, thus proving that such a situation complies with the elements of civil liability, that is: A) Illegality, B) Attribution factor, C) Damage, and D) Causal relationship. Counting on the support of the interviews applied to legal professionals, verifying that the damage affects the integral development of the child and adolescent, also confirming that the breach of the visitation regime constitutes a violation of the rights of children and adolescents. Concluding that it has been determined that the non-compliance with the visitation regime by the obligated parent causes material, psychological and/or emotional damage to the child and adolescent, violating their rights, which thus constitutes civil liability.
