The motivation of judicial resolutions is one of the guarantees that individuals have, regarding the possible arbitrariness that the jurisdictional bodies that administer justice could commit, that is, the constitutional norm with an imperative nature, determines the duty of the bodies to give reasons. of decision. The duty to motivate being inevitable, the magistrate who hears a case, where a cause exempting from criminal liability due to psychological anomaly is presented, the aforementioned -judge- would also have to argue, regarding two specific scenarios, for the first; “The lack of understanding of the criminal nature of his acts” and, for the second; “not be determined according to the aforementioned understanding”, these two aspects mentioned, the magistrate would inexorably have to argue in these specific cases. In this context, the following has been formulated as a question that supports the investigation: “Is there a due motivation in the sentences that determine non-imputability due to psychological anomaly issued by the Superior Court of Justice of La Libertad between the years 2020 and 2022? Given this approach to the problem, the following hypothesis was formulated: “There is a deficient motivation of judicial resolutions in the sentences that determine non-imputability due to psychological anomaly issued by the Superior Court of La Libertad between the years 2020 to 2023.” This incited response to the problem has been proven affirmatively, because, being a descriptive explanatory investigation, it has been achieved via the doctrinal, analytical and hermeneutical method, explaining that there is no motivation according to the standards of the prescribed constitutional norm
