The present research work tries to analyze if the application by the jurisdictional organs of the so-called legal relative presumption of the truth of the facts exposed in the application, as a consequence of the declaration of the defendant's default, makes possible the issuance of a decision fair in the civil process, in accordance with the guidelines of the Constitutional State of Law, and taking into consideration that the immediate finality of the Peruvian civil process is to make effective the substantial rights of those who request jurisdictional protection (article III TP CPC / 1993). For this purpose, we have used the conception of the Italian author Michele Taruffo on ““just decision““, and on the sufficient and necessary conditions for its issuance.
