Abstract: La Tesis denominada “La desproporcionalidad de la pena en el delito de
violencia contra la autoridad en su forma agravada”, responde a la necesidad
de determinar si en sanción penal fijada por el legislador en la Ley y aplicada
concretamente por el juzgador es proporcional al bien jurídico protegido en el
delito de Desobediencia contra la Autoridad en su forma agravada.
En este sentido, la formulación de nuestro problema fue el siguiente: ¿De qué
manera el artículo 367 del Código Penal que sanciona el delito de violencia
contra la autoridad en su forma agravada contiene una pena
desproporcionada?, para lo cual proponemos la siguiente hipótesis : Siendo
que el inciso 3) del segundo párrafo del artículo 367 del Código Penal,
sanciona el delito de violencia contra la autoridad en su forma agravada con
una pena superior a la que corresponde a delitos con bienes jurídicos de
mayor relevancia social y jurídica, contiene una pena desproporcionada.
En este orden de ideas, nos abocamos al estudio de la Doctrina y Legislación
para demostrar dicha hipótesis, dado que se han aplicado sentencia de prisión
efectiva.
De esta manera se ha logrado concluir que la pena que establece el legislador
al delito deberá ser proporcional a la importancia social del hecho. En este
sentido no deben de admitirse penas o medidas de seguridad, exageradas o
irracionales en relación con la prevención del delito.

In this vein, we apply ourselves to the study of the Doctrine, Legislation and Jurisprudence to prove this hypothesis, as have been applied effective prison sentences Thus, it has been achieved to conclude that the penalty established by the legislature to crime must be proportionate to the social importance of the fact In this regard, it should not be admitted penalties or security measures exaggerated or unreasonable in relation to crime prevention.
