This research analyzes from the perspective of the elements of the Health Rights, such as availability and affordability, the topic of access to medicines and the current system for Patents and Protection of Data Submitted (for the registration) of Pharmaceuticals Drugs, implemented by the Free Trade Agreement (FTA) with United States of America, which are unknown of the true nature of drugs as social goods. Health rights has been affected before the protection given through patents and protection of data submitted (for the registration) of pharmaceuticals drugs, existing drugs as a result of the FTA with the United States, causing that medicines become inaccessible, in other words, unavailable and unaffordable property, especially for vulnerable groups, which do not have the information or the ability to organize and make their voices heard. The development of this research has managed to identify regulatory factors characteristic of the current patents system and protection of data submitted (for the registration) of pharmaceuticals drugs, arising from the FTA with the United States, which are important to know for the appropriate regulation in the evaluation of the grant of such protection, thinking off the needs of public health and; the proper use of the safeguards establish in the same FTA with the United States , which make reference to the Declaration Ministerial in Doha, one of them being the mandatory license.
