It may be noted that throughout the years, our system of justice has evolved, as to the importance and necessity of introducing new formulas or process our different legal trends, in order to ensure that the delivery of justice more efficient. Thus, one of the procedural trends imported into our judicial system and criminal, is the process of early termination from the American law, which was created and subsequently adopted in our system in order to not only avoid criminal proceedings necessary for the accused but also to enforce the right of individuals and decongest the judicial system itself, for procedural burdens. Given the above, it is appropriate to ask whether this legal institution, adopted by our Peruvian criminal law can be applied in the process of offenders; ie the need for the institution to our Code of Children and Adolescents. Under this premise, this thesis will develop the benefits - one, protection for the child and / or adolescent offender under Principle of Best Interests of the Child - would entail incorporating the process of early termination.
