Our research thesis seeks to problematize the law that regulates the eviction process with notarial intervention based on the following question: How does Law No. 30933, eviction law with notarial intervention, affect the landlord when the intervention occurs? of a third party in said special eviction procedure?, the same one that is answered wi th the following hypothesis: ““The deficiency that exists at the time of regulation of the opposition of third parties in the law affects the right of the owners when the process““. In the same way, we have set ourselves the following general objective: ““Det ermine the way in which Law No. 30933, eviction law with notarial intervention, affects the landlord when a third party intervenes in said special eviction procedure.““ Finally, we have reached the following general conclusion: “Law No. 30933, eviction law with notarial intervention, does not regulate in any of its rules the intervention of third parties in the notarial stage; therefore, we maintain that said legislative omission seriously undermines the lessor's right to recover his property; s ince if such a situation arises, the notary will have no other way than to apply additionally to law 26662, which regulates the opposition in the event that the notary is hearing non contentious matters; Therefore, said notarial authority will have to susp end or stop the process and refer it to the Judicial Power and this will entail that the lessor go through a plenary process (the summary regulated in the CPC) to recover his property, which that attempts not only against speed and procedural economy; but also against the much loved and little achieved Jurisdictional Guardianship
