Abstract: La presente investigación, titulada “Modificación del plazo legal para formular
observaciones al requerimiento acusatorio contemplado en el artículo 350° del
Nuevo Código Procesal Penal”, se llevó a cabo debido a la relevancia de los
derechos y principios afectados por la regulación vigente en el Código Procesal
Penal. Este trabajo académico identificó un vacío normativo en la legislación
penal adjetiva, específicamente en el artículo 350° inciso 1 literal a), que no
considera la naturaleza ni la complejidad del proceso al determinar el plazo
otorgado a los sujetos procesales, particularmente al imputado, para responder
al requerimiento acusatorio presentado por la fiscalía.
Dentro del marco contextual antes descrito se elaboró como enunciado del
problema el siguiente: “¿Cuáles son los fundamentos jurídicos que permitirían
modificar el plazo legal para formular observaciones al requerimiento
acusatorio en el proceso penal peruano?”; en relación a ello se buscó la
información necesaria en fuentes como la doctrina y la jurisprudencia, para
determinar que es posible integrar ese vacío o esa corta redacción del artículo
antes citado, luego del análisis de los documentos que presenta una técnica
para recopilar, organizar y sintetizar la información de los materiales utilizados
así como también la técnica que se utilizó como el fichaje, se llegó a comprobar
la hipótesis siguiente : “los fundamentos jurídicos que permitirían modificar el
plazo legal para formular observaciones al requerimiento acusatorio en el
proceso penal peruano son: el derecho de defensa; el principio de igualdad de
armas; y, el plazo razonable en función de la complejidad del proceso
The present investigation, titled ""Modification of the legal deadline to make observations on the accusatory request"", was carried out due to the relevance of the rights and principles affected by the current regulation in the Criminal Procedure Code. This academic work identified a regulatory gap in the adjective criminal legislation, specifically in article 350° paragraph 1 literal a), which does not consider the nature or complexity of the process when determining the period granted to the procedural subjects, particularly the accused, to respond to the accusatory request presented by the prosecution. Within the contextual framework described above, the following was prepared as a problem statement: “What are the legal bases that would allow modifying the legal period to make observations on the accusatory requirement in the Peruvian criminal process?”; In relation to this, the necessary information was sought in sources such as doctrine and jurisprudence, to determine that it is possible to integrate that gap or that short wording of the aforementioned article, after the analysis of the documents - which was the technique that was used - , as well as the signing, the following hypothesis was verified: “the legal bases that would allow modifying the legal period to formulate observations on the accusatory requirement in the Peruvian criminal process are: the right of defense; the principle of equality of arms; and, the reasonable period depending on the complexity of the process
