Currently some countries recognize Parental Alienation Syndrome, others try to include it in their legislation but are not precise, the truth is that there is certainty of the validity of this syndrome in daily life at an international and national level, which directly affects violating the fundamental rights of the child and/or adolescent, therefore this research aims to deepen the studies regarding the need to regulate the Parental Alienation Syndrome in Peruvian legislation as a budget of psychological violence to guarantee the rights of the child and/or Teen. Along these lines, the present research titled “Parental Alienation Syndrome as a presumption of the crime of psychological violence in Peru” aims to analyze and determine the relationship of Parental Alienation Syndrome with psychological violence. The research by type of orientation or purpose is basic, according to the contrast technique it is non-experimental, with a qualitative approach, with a non-experimental design of a descriptive type. In this research, the interview technique was used, where the population was made up of legal operators specializing in family law and psychology, as well as regulations and comparative legislation; The instrument of interview guides was applied to the sample made up of 05 judicial legal specialists, 05 prosecutors, 05 trial lawyers, all of them specialists in family law and 05 psychologists. Likewise, the techniques that were applied in this research are: interview technique, through its instrument of interview guides; documentary collection technique, using documentary analysis guides as an instrument; observation technique, through observation guides. Regarding the methods used to develop this research, the scientific method was used; logical methods, such as the analytical, inductive, deductive, comparative method, synthetic, statistical method; and legal methods, such as the hermeneutical, dogmatic, exegetical, literal method. The development of this research came to the conclusion that, in effect, the development of Parental Alienation Syndrome constitutes a presumption of psychological violence in Peru, because it violates the fundamental rights of the child and/or adolescents, such as the right to have a family. and not be separated ix from it, the right to psychological integrity, and the right to free development of personality
