The aim of this paper is to analyse the infringement of related rights to copyright, based on the complaint filed by Inter Artis Perú before INDECOPI against Inversiones Generales Libra S.A.C. The complaint arose from the retransmission of audiovisual works at the Hotel Britania Miraflores without paying the required remuneration for the public communication of performances and executions managed by Inter Artis. The analysis of this dispute is significant as it examines how the rights of performers and actors are protected within the framework of administrative law and copyright in Peru. Additionally, it outlines the various stages of the process, from the Copyright Commission to the Specialised Chamber for Intellectual Property of the Competition and Intellectual Property Tribunal of INDECOPI. Throughout these stages, the Commission upheld Inter Artis' complaint, ordering the defendant company to pay the remuneration and a fine. In conclusion, the ruling acknowledges the obligation to pay for the public communication of audiovisual performances. However, it also raises issues regarding the proportionality of the applied fees and transparency in the calculation of remunerations. This resolution sets an important precedent on related rights and their interpretation within Peru’s intellectual property system.
