The purpose of this investigation is to study and analyze the decision of the Second Supreme Court of Justice of the Republic, which chose to declare unfounded the appeal filed by the worker in relation to reinstatement for fraudulent dismissal, having as its main objective the analysis and study of the breach of labor good faith in the misuse of medical leave. Therefore, this legal research aims to identify legal concepts broadly and the theoretical foundations of the case. To do this, information has been compiled from different bibliographic sources, jurisprudence and law compared to the legislation of different countries. This analysis highlights how the improper use of medical rest can clearly affect the contractual relationship between the parties. Therefore, in the first chapter we will talk about the most important aspects found in each of the instances and in the analysis to determine how unfounded the appeal presented by the worker is. Then, in the second chapter, the key concepts of the research, the jurisprudence of cases similar to the one in this study and the comparative legislation of other countries are pointed out to understand the similarities and differences with our case. Finally, in the third chapter, an analysis of the research topic is carried out, comparing it with the information obtained in the previous chapter to finally develop the recommendations and conclusions of our work.
