The name, more than a mere identifier of a person in society, has a legal duality as a right and duty as it is clear from the reading of the Article 19 of the Peruvian Civil Code. Therefore, the present Work of Professional Sufficiency analyzed the Casatoria Ruling N° 835-2016, which recognizes the right to change the name based on the right to self-determination of personal identity. The analysis focused on evaluating how the ruling at the cassation level treated the name only as a right, without adequately weighing its aspect as a duty towards the community. Under the rationale that the name is a protected right, the judicial process should also consider whether requests for change negatively affect society, which constitutes an interpretation of its dimension as a duty. From the review of the relevant facts of this study, the doctrine, law and jurisprudence reviewed, it is concluded it is imperative that the judicial adjudication of the name change not only protects the individual interests of the plaintiff, but also safeguards the collective interests, balancing both legal facets. This approach would provide a more solid and equitable basis for judicial decisions in similar cases, thus avoiding one-dimensional interpretation of such legal figure and, on the contrary, promoting and analysis that also compromises social welfare.
