The present study focuses on the repercussions of the right to procedural protection and arbitrary dismissal, based on the analysis of the sentence corresponding to the Labor Cassation 13735-2016 of Lima; the legal issue addressed involves the evaluation of the legality and reasoning behind the resolution that dismissed the claim of nullity and fraud for dismissal filed by the worker Barboza against the Ministry of Development and Social Inclusion. The research delves into the relationship between procedural protection and decisions regarding arbitrary dismissal, highlighting the distinction between dismissal and termination of contracts, and the role of key institutions such as the Judiciary, SUNAFIL and MTPE; it also considers the impact of the deactivation of state programs such as PRONAA, which when replaced by other agencies, causes the workers involved to face the termination of their contracts and possible dismissals. Consequently, it is concluded that in order to ensure effective protection of labor rights, it is essential that judicial decisions accurately reflect the real circumstances of the dismissal and the situation of the worker's contract, thus avoiding the issuance of decisions that, although correct in theory, may be unjust in practice.
