This report is prepared based on the analysis of the judgment related to Cassation No. 21186-2019, which addresses the case of Flor de María Mejía Chinchay. In this judgment, it was determined that her employment relationship began on March 1, 2015, recognizing her as a worker under the regime of Legislative Decree No. 276 and Law No. 24041, although she was denied access to the administrative career. The Superior Chamber confirmed this decision on June 13, 2019, noting that the plaintiff had been hired from March 2015 to April 2018 under a service lease modality, performing permanent functions. This context led to the denaturalization of the contracts and the formal recognition of her employment relationship. The purpose of this paper is to perform the analysis of the cassation, which lies in its implication on the interpretation and application of labor regulations in situations where contracts are inappropriately used to cover up permanent labor relationships. The judicial decision underlines the need to respect the principle of the primacy of reality, which establishes that what really matters is the effective nature of the labor relationship, beyond the contractual form used. In order to carry out the present analysis, legal, scientific and academic sources were consulted, which allowed us to analyze the legislator's position, the singular votes, given that the labor reinstatement was imminent, not only because of its denaturalization, but also because of the violation of the aforementioned constitutional rights.
