This professional sufficiency work is based on the analysis of the ruling file No. 0014-2015, issued by the Constitutional Court. Through which, the unconstitutionality of articles No. 1 and 2 of Law No. 29618 is evaluated, which declares the private property of the State imprescriptible. This shows a clear tension between the public interest protected by the State and the property rights and equality of individuals. Therefore, this plenary is considered one of the most relevant, since it establishes a precedent on balancing the right of private property with the needs of the State to preserve its assets for the common good. In light of the above, the Constitutional Court declared that the law under discussion does not contravene the Political Constitution. Therefore, this investigation questions whether the absolute protection of state assets through imprescriptibility is the best solution to guarantee efficient management of public resources. The analysis examines whether the State fulfills its social purpose or whether an imbalance is generated for those citizens who occupy state lands in good faith and for long periods. Finally, given the evident tension between the public interest and property rights, we offer a constructive critique of Law No. 29618, exploring alternatives that can guarantee a more balanced and respectful management of fundamental rights in Peru.
