Objectivity and impartiality are both principles that guide the prosecution career and its exercise. However, there are criteria and laws that cover the full range of grounds by which the work of a prosecutor can be questioned. This research work aims to analyze Judgment No. 04382-2023-PA/TC, in which the actions of Prosecutor Domingo Pérez Gómez are questioned in an investigation for obstruction of justice, linked to the money laundering case of Keiko Fujimori and others. In this ruling, the Constitutional Court opts to uphold the protection claim, declaring null the provision 1-2019-FSCEE-MP-FN that allowed Prosecutor Domingo Pérez to investigate the case, thus forming a majority vote in favor of the existence of a bias in the prosecutor's stance on the facts under investigation. We share the position of the individual opinion of Judge Monteagudo Valdez, who argues that two errors underlie the decision of the ruling. These are: assuming without support that the prosecutor’s conviction deviates from his role in leading the investigation, and that there is a subjective interest parallel to the accusation made by the prosecutor. In this regard, it is important to highlight that the principles of objectivity and impartiality are part of the prosecutorial career. However, their requirement is limited to the exercise of the prosecutor’s duties as stipulated in Law 30483. Therefore, the lack of objectivity in the prosecutor's actions is not established.
