The case analyzed corresponds to appeal for annulment Nº2848-2017-Lima, which addresses a material conflict regarding the dissolution of the marital bond due to adultery. The central legal issue is the expiration of the action for divorce on the grounds of adultery, in accordance with Article 339 of the Peruvian Civil Code. The ruling discusses the application of this time limit in situations where adultery is considered a continuing offense. Our research focuses on analyzing the correct interpretation of the expiration in case of divorce due to adultery, taking into account both the rights to the affected spouse and legal stability. We have selected this topic due to its implications for the protection of family rights and its flexible interpretation by judges. In conclusion, we argue that expiration should be applied rigorously to avoid abuse but should also allow necessary flexibility in case of continued adultery. Our research proposes a reform of Article 339 to provide greater clarity in the interpretation of time limits and ensure fair protection for all parts involved.
