This professional sufficiency work analyzes the demand for unconstitutionality against Emergency Decree 026-2019 and its amendment, Emergency Decree 027-2019, recorded in file N° 00015-2020-PI/TC. These regulations would directly affect the territory of the peasant communities of Apurímac and Cusco due to the construction of the Southern Road Corridor. From this, the aim is to present the three legal grounds considered by the magistrates of the Constitutional Court: the legislative powers of the Executive Branch during a parliamentary interregnum; the proper motivation for proceeding with expropriation according to the Framework Law on Acquisition and Expropriation of Real Estate; and whether the right to prior consultation, established in ILO Convention 169, should also be applied to the peasant communities of Peru. A detailed analysis of these grounds is conducted in relation to Emergency Decrees 026-2019 and 027-2019, as well as to Plenary Sentence 198/2022. This ruling establishes important criteria regarding the nature of the right to prior consultation and its connection to the protection of the rights of the affected communities. Finally, an analysis of Plenary Sentence 198/2022 will be conducted, along with a critique of the singular vote of Magistrate Ledesma, who urges us to improve Peruvian laws on prior consultation. She believes that the rights and benefits established by Convention 169 should be implemented and made applicable in Peru, as these communities share the same characteristics as indigenous peoples.
