The Fujimori case is a prominent subject in the media, with the central debate focusing on whether he should have been released from prison. Despite the former president's release, the subsequent legal processes remain of significant importance. By a resolution dated November 21, 2023, the Constitutional Court declared the requests for clarification inadmissible, remitting the proceedings to the court of origin for execution. However, Fujimori's defense subsequently filed an appeal for reconsideration, resulting in an order for his immediate release on December 4, 2023. This investigation explores the scope of the appeal for reconsideration as a procedural mechanism for the execution of sentences. It examines not only the annulment of decrees and orders issued by the Constitutional Court but also the constitutional rights and international regulations promulgated by the Inter-American Court of Human Rights. To this end, a diverse array of research sources has been utilized, including books and chapters, indexed scientific articles, national jurisprudence, and both national and international research studies. It can be inferred that, in this case, the execution of sentences issued by the Constitutional Court through the use of the appeal for reconsideration does not constitute a transgression of the Rule of Law, considering the State's responsibility in relation to acts that violate human rights.
