The present work of professional sufficiency has been developed based on the content exposed in the Judgment of the Constitutional Court STC 02653-2021-PA/TC, with the purpose of analyzing the decision of the Constitutional Court (hereinafter - TC), which declared the amparo petition requested by Mrs. Susel Ana María Paredes and her partner Gracia María Francisca Aljovín de Losada inadmissible. In this regard, it should be noted that the Court's ruling responds to the denial of marriage registration before the National Registry of Identification and Civil Status (hereinafter referred to as "Reniec") requested by the plaintiffs, as they had contracted a civil marriage in the city of Miami, United States of America. Likewise, it aims to reflect on whether the decision issued by the Court, declaring the amparo petition inadmissible, is valid or not, due to the fact that the arguments on which the decision is based are supported by Article 7.1 of the New Constitutional Procedural Code, which establishes the inadmissibility of the petition when the facts and the requested relief are not directly related to the constitutionally protected content of the invoked right. In this sense, it is relevant to indicate that this argument has been used by the majority of judges to admit and declare the non-existence of the constitutional right to marriage between same-sex individuals. Therefore, it can be observed that the Court's decision contravenes fundamental rights such as equality, human dignity, identity, the free development of personality, the pursuit of happiness, among others.
