The objective of this research work is to provide a legal procedure that allows a greater operationally to the Direct Treatment as a dispute settlement as the resolution mechanism in the “Tax deduction for Public Works” Agreements. The choice of direct treatment as another dispute resolution mechanism has a conventional nature, in which disputes related to the interpretation, resolution, non-existence, ineffectiveness or invalidity of the said Agreement are resolved. In this regard, the “principle of management by results” incorporated in Law No. 29230, prioritizes the use of direct treatment with regards form arbitration when the result of the latter is less convenient from costs and benefits perspective. The establishment of a procedure of legal character will allow the parties that participate on the “Tax deduction for Public Works! Agreement of use general guidelines to achieve an effective direct dealing relationship as a dispute mechanism and evaluate its use against the costs of the arbitration.
