The present research work arises from the issue of parliamentary immunity which is used as a privilege affecting the constitutional right to equality before the law, which is considered as a solution the reform via referendum, is certainly a problem of social and legal nature affecting the Peruvian State pillars. In the first chapter of this thesis develops the problem and the methodological aspects of the study that is addressed in this research. In chapter II, mentioned the background of the thesis, previous research by other authors at the national and international levels. Chapter III addresses Jurídico parliamentary immunity, first development framework second definition, historical background, fields of application, procedure of the immunity, characteristics and last reflections: immunity or impunity, parliamentary immunity as personal - privilege affecting the right to equality and to the jurisdictional tutelage effective and right to equal before the law; being the starting point for our research. In chapter IV, it develops the constitutional right to equality before the law, we will develop the preliminary ideas, definition and content of the right to equality before the law. In chapter V development reform Via Referendum, in terms of evolution, definition and regulation of the referendum, the reform of the Constitution via referendum, theory that serves to substantiate this thesis. In chapter VI outlines the draft law of the constitutional reform of parliamentary immunity, as a solution of the problem which is postulated in this thesis.
