Abstract: La presente investigación tuvo como objetivo establecer qué razones justifican la
incorporación del derecho a elegir morir con dignidad en el ordenamiento jurídico peruano.
Para lo cual, se realizó la búsqueda literaria de conceptos como vida y muerte, desde la
perspectiva de diversas áreas del conocimiento como la biología, sociología, la psicología, la
filosofía y la antropología; asimismo, el estudio de diversas legislaciones en relación a este
novísimo derecho que integra a la libertad y dignidad como fundamento. Su realización buscó
ampliar una investigación doctrinal y argumentativa, aplicando un análisis documental con un
diseño hermenéutico.
A partir de los hallazgos encontrados y desde un análisis argumentativo de los antecedentes
y propuestas legislativas de otros países, se concluyó́ que en la actualidad existe la necesidad
del reconocimiento del derecho a elegir morir con dignidad en el ordenamiento jurídico
peruano; existiendo las condiciones jurídicas, filosóficas, psicológicas, sociológicas y
antropológicas suficientes como para integrar este nuevo derecho al ordenamiento jurídico
peruano.
Los cambios sean sociales o jurídicos no suelen ser aceptados al comienzo, existe un
proceso de negación, salir de la esfera de lo común y cómodo; sin embargo, existe una
constante en la naturaleza del humano, la adaptación. En consecuencia, la empatía y el amor al
prójimo deben ser el motor generador de cambios en los propios paradigmas, soltar las ideas
que limiten los derechos de las demás personas, entender que solo somos momentos en este
vasto universo y que nuestro fin es ser y no existir.
The purpose of the present investigation was to establish what reasons justify the incorporation of the right to choose to die with dignity in the Peruvian legal system. For this, the literary search of concepts such as life and death was carried out, from the perspective of various areas of knowledge such as biology, sociology, psychology, philosophy and anthropology; the study of various legislations in relation to this new right that integrates freedom and dignity as a foundation. Its realization sought to expand a doctrinal and argumentative research, applying a documentary analysis with a hermeneutic design. On the basis of the findings found and an argumentative analysis of the background and legislative proposals of other countries, it was concluded that at present there is a need for recognition of the right to choose to die with dignity in the Peruvian legal system; existing the juridical, philosophical, psychological, sociological and anthropological conditions sufficient to integrate this new right into the Peruvian juridical order. Changes whether social or juridical are not usually accepted at the beginning, there is a process of negation, leaving the sphere of the common and comfortable; however, there is a constant in the nature of the human, adaptation. Therefore, empathy and love of neighbor must be the engine of change in the paradigms themselves, release ideas that limit the rights of other people, understand that we are only moments in this vast universe and that our goal is to be and not exist.
