Resumen: El derecho fundamental a la educación debe estar revestido de calidad para su pleno ejercicio;
sin embargo, la realidad ha demostrado que, a pesar de los esfuerzos realizados, ello no
siempre logra materializarse. Es por esta razón que esta investigación se enfocó en describir la
situación de la calidad educativa superior en el marco del respeto del derecho fundamental a la
educación en la región Cusco durante el año 2019. El estudio contó con la participación de 20
estudiantes y 6 especialistas en Educación y Derecho Constitucional, pertenecientes
universidades licenciadas en Cusco, quienes a través de entrevistas compartieron sus
experiencias con relación a la calidad educativa y el ejercicio del derecho fundamental a la
educación. Adicionalmente, se aplicó la técnica de investigación documental legislativa para
identificar los fundamentos jurídicos nacionales pertinentes a la calidad educativa en el nivel
universitario. Los resultados de la investigación cualitativa realizada dieron a conocer que por
parte de las universidades se vienen cumpliendo con los estándares de calidad impuestos por la
Superintendencia Nacional de Educación Superior Universitaria; sin embargo, los estudiantes
parecen ajenos a dicho proceso, al haber demostrado falta de conocimiento o poco
aprovechamiento de los servicios complementarios que sus universidades han presentado en
materia de calidad educativa. En consecuencia, se plantearon recomendaciones que buscan
generar una mejor integración de los estudiantes a la universidad y así asegurar un ejercicio
pleno de su derecho fundamental a la educación.
The fundamental right to education must involve quality to guarantee its full exercise. However, reality has shown that, despite the efforts, this is not easy to achieve. This is why this research focused on describing the situation of higher education quality as a form of respecting the fundamental right to education in Cusco during 2019. The participants in the study were 20 students and 6 specialists in Education and Constitutional Law from licensed universities in Cusco. They shared their experiences in relation to educational quality and the exercise of the fundamental right to education through interviews. Additionally, we used the legislative documentary research technique to identify the national legal foundations relevant to educational quality at the university level. The results of the qualitative research revealed that universities have been complying with the quality standards imposed by the National Superintendency of Higher University Education. However, students seem to be excluded from this process because they showed a lack of knowledge and little use of the complementary services that their universities offer in terms of educational quality. Based on the findings, we made recommendations oriented to generate a better integration of students into the university so they can fully exercise their fundamental right to education.
