Abstract: El presente trabajo de investigación titulado “La Prueba Indiciaria Como Prueba De Oficio En
El Proceso Penal Peruano” busca esclarecer si El Juez al momento de valorar las pruebas dentro
de un Proceso Penal, puede invocar de oficio la prueba indiciaria.
En la práctica judicial, y con el fin de buscar la verdad; ¿Él Operador Judicial podrá ordenar la
actuación de Prueba Indiciaria?, en anteposición al principio de imparcialidad de las partes, y a la
presunción de inocencia en el proceso, ya que esta actuación de oficio también podría ser una
excepción a la carga de la prueba.
Como objetivo general, se buscara establecer; si El Juez al momento de valorar las pruebas
dentro de un proceso penal, puede invocar de oficio la prueba indiciaria, el artículo 385 del Código
Procesal Penal, establece de manera expresa que el Juez Penal una vez culminada la recepción de
las pruebas, podrá disponer, de oficio o a pedido de parte, la actuación de nuevos medios
probatorios si en el curso del debate resultasen indispensables o manifiestamente útiles para
esclarecer la verdad, contradiciendo aparentemente el principio dispositivo.
Y como objetivos específicos se Identificará si es obligación del Ministerio Público, recurrir en
algunos casos a la prueba indiciaria en el Proceso Penal Peruano, ya que esta Institución es la
encargada de la actuación probatoria. Otro objetico específico será determinar cómo se debe
utilizarse la prueba indiciaria en un Proceso Penal, para así contribuir a la comunidad Jurídica
The present investigation work entitled “The Proof of Evidence as an Occupational Proof in the Peruvian Criminal Procedure” seeks to clarify whether the Judge, at the time of assessing the evidence within a Criminal Procedure, can invoke the indiciary evidence ex officio. In judicial practice, and in order to seek the truth; Will the Judicial Operator be able to order the Indiciary Proof of action ?, before the principle of impartiality of the parties, and the presumption of innocence in the process, since this ex officio action could also be an exception to the burden of proof. As a general objective, it will seek to establish; If the Judge at the time of assessing the evidence within a criminal proceeding, may invoke ex officio the evidence, article 385 of the Criminal Procedure Code, expressly establishes that the Criminal Judge once the receipt of the evidence is completed, may provide , ex officio or at the request of a party, the performance of new evidence if in the course of the debate they were indispensable or manifestly useful to clarify the truth, apparently contradicting the device principle. And as specific objectives it will be identified if it is the obligation of the Public Ministry, to resort in some cases to the evidence in the Peruvian Criminal Procedure, since this Institution is in charge of probative action. Another specific objective will be to determine how the index evidence should be used in a Criminal Procedure, in order to contribute to the Legal Community
