The present research work is titled "The omission of family assistance as a result vulner the principle of the superior interest of the child and their economic and social rights", it focuses on the issue of the impact on the child, because the omission family assistance is a crime that occurs when the person obliged to provide food does not do so, totally or partially. This crime is classified in article 149 of the Peruvian Penal Code, and is punishable by a custodial sentence of no more than three years. Thus, this crime is directly linked to the principle of the best interests of the child, this being a guiding principle of international human rights law, which establishes that in all measures adopted concerning children, take into account primarily the best interests of the child. After the impact that occurs due to non-payment of food, the economic and social rights of children are affected, thus preventing their comprehensive development and well-being from being guaranteed. These rights include the right to food, education, health, housing, work, rest, and recreation, among others.
